A new way Courts are busting Trusts
Over the past two years, John Brown has provided invaluable insights and lessons with regard to the successful creation and operation of Trust structures.
NZ Courts have, on several occasions, disregarded a Trust where the Trust is the defendant's "Alter Ego", and the Trust has been ineffective to keep assets from the plaintiff. However, there is another recent NZ decision where the Court upheld the Trust. What made the difference?
