2007 will see the implementation of major legislative and regulatory change for managed funds and superannuation schemes. Changes include taxation of funds and investments, KiwiSaver and further progress in the review of financial products and providers by the Ministry of Economic Development.

In the ASFONZ PIE Warmer series, Murray Sarelius (Tax Partner, KPMG) and Darshana Elwela (Tax manager, KPMG) will provide an overview of the tax rules applying to portfolio investment entities (PIEs) and an opportunity to consider some of the practical consequences of the legislation.

The PIE regime may have a significant positive impact on returns to investors, but it creates additional complexity for fund managers and trustees. This PIE Warmer will help prepare you for the PIE regime, with a focus on the choices available to, and decisions required of, managers and trustees. In particular:

• The qualification criteria for the PIE regime
• The requirements and considerations when converting an existing fund into a PIE
• The options available to PIEs to account for tax on a quarterly, annual or provisional tax basis
• The consequences of the PIE regime for unit pricing, valuation of member interests, and investor returns
• The changes to the taxation of investments made by PIEs, including the new fair dividend rate (FDR)rules and Australasian equities exemption.
