Property problems: Steps to stop landowners becoming motorway road kill

Q. It has been announced that a new motorway is proposed and my property will be in the middle lane. It has destroyed its value and in fact, it is probably unsaleable. What can I do about it - or am I a dead possum?

A. To answer this question it is necessary to understand the processes involved. If the road is a motorway, then Transit New Zealand will be building it.

To build the motorway, Transit will need to obtain the necessary planning consents under the Resource Management Act 1991 and buy your land under the Public Works Act 1981.

These are two separate processes and, in the normal course, land will not be purchased until the planning consents have been obtained
